WHARTON’S BLUFF--PHASE A 

Policy Resolution Number 2018-03-6

Relating to Trash/Recycle Policy

 

WHEREAS, the By-Laws for Whartons Bluff Phase A  ARTICLE III, Board of Directors: Selection, Meetings, Powers Section 2. Powers and Duties. The Board shall have the power to administer the Association’s affairs, perform the Association’s responsibilities, and exercise the Association’s rights as set forth in the Governing Documents and as provided by law.  The Board may do or cause to be done on the Association’s behalf all acts and things except those which the Governing Documents or Delaware law require to be done and exercised exclusively by the membership generally.

WHEREAS, § 81-302. Powers of unit owners’ association of DELAWARE UNIFORM COMMON INTEREST OWNERSHIP ACT (DUCIOA) (17) May exercise any other powers necessary and proper for the governance and operation of the association.

NOW, THEREFORE, BE IT RESOLVED that the Board of Directors (Executive Board) adopts the following policy effective immediately

Unit Owner Responsibilities

  1. All trash and recycle will be collected by a single trash hauler, “hauler,” selected by the Executive Board through a competitive bidding process based on best value and overall quality of service.
  2. All unit owners must use this selected trash hauler. No other hauler will be permitted in the Community.

NOTE: it is permissible for unit owners to not use the Board-selected hauler and to dispose of their trash/recycling by taking it to an approved collection facility.

  1. Unit owners are required to ensure that their renters who require trash/recycle service use the approved hauler.
  2. Unit owners will pay for trash/recycle collection directly to the hauler company that is selected by the Executive Board.
  3. The Executive Board will enforce this resolution through our current “Non-compliance & Fine Schedule Resolution” on the Community website whartonsbluff.org.
  4. The Board recommends that trash/recycle receptacles be placed at curb after 5PM of the day before the next scheduled collection day.

 

Reminder: Trash/recycle containers may not be stored outside the unit, containers must be stored in the unit owners’ garage.

Adopted by the Executive Board on March 12, 2018.
